Terms of service
These terms apply to agencies that use Buyerbase and to their staff. Buyers who use the portal of an agency are covered by their agreement with that agency.
Last updated 8 September 2026
1. The service
Buyerbase is a white-label workspace for buyer agencies: buyer records, documents, houses, viewings, a branded buyer portal and reporting. We provide it as a subscription over the web.
2. Accounts and members
The agency owner creates the workspace and invites staff. There is no limit on the number of members and no charge per member. The owner is responsible for who has access and for keeping credentials safe.
3. The plan, commissions and billing
An agency is either on a trial or on the one plan. The trial lasts 30 days, includes everything and needs no card. The plan, Buyerbase, costs € 99 per month or € 990 per year, excluding VAT, with every feature and unlimited members. Prices are the prices shown on the pricing page at the time of purchase.
Besides the plan, two commissions apply to completed sales. When the agency acted for the buyer, the commission is 2.9% of the fee the agency charged that buyer, without a cap. When the agency acted for the seller, it is 0.01% of the sale price, at most € 200 per house, for the first ten agencies that subscribe and for as long as they stay subscribed; for every later agency it is 0.03%, at most € 500 per house. A trial never pays a commission and cannot complete a sale. Commissions are invoiced once a month for the sales completed the month before, and every completed sale is checked against the Kadaster.
Monthly plans renew monthly. Yearly plans are billed up front and cost ten months rather than twelve, so a year gives two months free. We may change prices with 30 days notice; changes apply from the next renewal.
4. The lifetime deal
An agency that Buyerbase has granted a lifetime deal pays a one-time fee of € 7.500 excluding VAT and no subscription for the life of the product, with unlimited members. Both commissions in section 3 start six months after the deal is granted, and the sale commission is charged at the rate of the first ten agencies for as long as the deal lasts.
The lifetime deal includes every feature of Buyerbase, including features released after the agency joined, for as long as Buyerbase exists. In return we ask these agencies for regular feedback sessions.
The fee is due on signing. An agency may withdraw from the deal within 30 days of payment by writing to hello@buyerbase.app with a valid reason and the facts that support it, for example a material feature that was promised in writing and is not delivered, or a security or data protection failure on our side. If we agree the reason is valid, or cannot show otherwise within 14 days, we refund the fee in full and the workspace closes at the end of that month. After 30 days the fee is non-refundable.
The deal is tied to the agency named on the invoice and the agency cannot transfer it. It does survive a change of our own legal entity under section 10: the company that takes over Buyerbase takes over the deal on the same terms. If Buyerbase is discontinued, these agencies receive a full export of their data and 90 days notice.
5. Your data
The agency owns its own data and the data of its buyers. Buyerbase processes it only to provide the service, under the privacy policy and the data processing agreement. You can export your data at any time and we delete it after cancellation as described in the privacy policy.
Product analytics inside the app use a random identifier per staff account; by inviting staff the agency consents to this on their behalf, as described in the cookie notice.
6. Acceptable use
Do not use Buyerbase to store data you have no right to process, to send unsolicited messages, to probe or overload the service, or in breach of Dutch or EU law. We may suspend a workspace that puts other customers or the service at risk, and we will tell you why.
7. Availability and support
We aim for the service to be available around the clock and announce planned maintenance in advance. Support is by email at hello@buyerbase.app or through the help centre on working days. We reply to every support message within one working day. Larger agencies can agree a service level separately.
8. Liability
To the extent allowed by law our liability for any claim is limited to the fees the agency paid in the twelve months before the claim. We are not liable for indirect damage such as lost deals or lost profit. Nothing here limits liability for intent or gross negligence.
9. Term and termination
Monthly plans can be cancelled at any time and end at the close of the billing month. Yearly plans end at the close of the year. Either side may end the agreement immediately for a material breach that is not fixed within 14 days of notice.
10. Assignment and change of legal entity
Buyerbase is operated by a natural person trading under a registered trade name, and will move into a Dutch private limited company (besloten vennootschap) set up by the same operator to continue it. We may transfer this agreement and your subscription to that company, provided it takes on these terms unchanged, including the lifetime deal and everything already paid for. We give at least 30 days notice by email before the transfer takes effect and name the company and its Chamber of Commerce number. You do not need to do anything and your rights do not change.
Any other transfer of this agreement by us, including to an unrelated buyer of the business, needs your consent. You may transfer this agreement to a party that takes over your agency, with our consent, which we do not withhold unreasonably. Where a transfer touches personal data, clause 13 of the data processing agreement also applies and gives you 30 days to object on data protection grounds.
11. Governing law
Dutch law applies. Disputes go to the competent court in Amsterdam.
